Controle de polícia: a atuação da ouvidoria na atividade correicional

Resumo: This study compares the results of the administrative facts involving military police in Minas Gerais state which are directly recorded in the Corporation and when they are reported to the Police Ombudsman (Ouvidoria de Polícia). It discusses the control of police activity that is carried out by internal and external instances of the corporate officer, being that only police internal affairs division an internal division is responsible for the investigation of cases of professional misconduct. The first stage of this research was to verify if the cases of these two instances of records presented similar characteristics in relation to the profile of the administrative facts, considering the geographic region inwhich they occurred, the level of the involved officers, the identification of the complainant and the content of the transgressions. The results showed differences in the profile of the cases, which demanded the use of specific data analysis technique that would void the effect of these variables on the outcome of the cases. Was carried out a matchingcases analysis (1 x 1) of cases registered in the Police Ombudsman and those directly recorded on the police Corporation, in order to compare similar cases of each type of source. From there, it was calculated the effect of the instance of record of the administrative facts in their final results, i.e. the consistency or not of them. Both steps used logistic regression, which is a statistical technique that allows you to verify the effect of one or more explanatory variables in a dependent one. It was found that the rate of consistency of the administrative facts that are received directly by the military police Corporation, whether via internal affairs or through a police unit, is 15% higher than the 10% obtained when considering those reported by the Police Ombudsman. Alternatively, the odds ratio analysis points out that the chance of an administrative fact that comes directly to the military police be considered well-founded is 67% higher than the fact reported through the Police Ombudsman.
