Acordos TRIPS e TBT e seus reflexos nos depósitos de patentes farmacêuticas, comércio de produtos eletrônicos e no Índice Global de Inovação

Resumo: | The creation of the World Trade Organization (WTO) represented a significant milestone in the regulation of international trade since it began to address issues that were not in GATT 47. At the end of the Uruguay Round, thematic issues involving goods, services and intelectual property become matters of interest and relevance in the comercial relations between the countries. Accordingly, two important multilateral trade agréments to regulate intelectual property and trade goods, namely the Agreementon Intellectual Property Protection (TRIPS) and the Technical Barrier Treaty (TBT), proposed within the framework of the WTO. TRIPS aim to consolidate the global protection of intelectual property of WTO member countries so as not to create barriers to international trade. TBT has the objective of creating and regulating the use of technical barriers to international trade, so as not to create barrirs and restrictive technical standards. The intente of this paper is to analyze and discuss the TRIPS and TBT Agreements, assessing their importance and their possible impacton trade relations in the European Union (EU) and on the structuring of countries' intelectual property policies. For this purpose, primary and secondary data collected on imports and exports of electronic products and pharmaceutical patente deposits in Brazil, India, and Argentina, for a pre determined period before and after TBT and TRIPS and results compared to each other. These analyzes have shown possible effects of the TRIPS and TBT agréments on EU trade relations and on pharmaceutical patente deposits in the countries studied. It is also the object of the present study, the survey of the possible correlations of this data with the structure of the National Systems of Innovation and consequently, the positioning of the countries in the ranking of the Global Innovation Index (IGI). As such, the analyzed data also showed a fragility of the National Innovation System of Brazil (SNI), considering a representative percentage of deposits in the country of patentes by individuals, as well as by other countries, depicting the misalign men tbetween the institutions that integrate the Brazilian SNI. Finally, these analyzes reflect the low and current decline of Brazil's positioning in IGI. |
