A legislação urbanística e a produção do espaço: estudos do bairro Buritis em Belo Horizonte

Resumo: The present work discusses, starting from the study of the structuring process of a district,Bairro Buritis, the insert of the urban planning in the production of the space of BeloHorizonte. It analyses the main municipal urban laws of parcelling, occupation and use ofthe soil, especially concerning their instruments of town planning control and theirrelationships with the participation instances responsible for defining urban politics. Thehypothesis considered is: these instruments developed according to the increasingcomplexity of the processes involved in the production of the space and the capacity of thetown planning legislation in contributing for the improvement of the life quality and theincrease of the social justice is empowered by the way society participates in theseinstances. The study of these laws identified an important movement towards a moreintegrated treatment of the urban subjects, especially in the aspects related to theenvironment, to the areas occupied by the most devoid populations, to the treatment of thelocal particularities and the reinforcement of the social function of the property. In asimilar way, it was noticed an enlargement in the capacity of the participation instances incontributing for the reach of the town planning legislations, reflecting the process ofredemocratization of the country and the change in the paradigms adopted by the nationalurban planning. The study of Bairro Buritis's formation investigated the transposition ofthe devices foreseen in the laws for the social practices and looked for the identification ofnew tendencies for the municipal urban planning, which would be propitiated by theincorporation of the conflicts generated by the processes of appropriation and dominationof the space. In this sense, were identified two situations that can contribute to theemergency of new practices and urban politics: the insertion of the citizen in the process ofurban planning and the integrated application of the town planning legislations and ofenvironmental control.
