Resumo: | This thesis aims at approaching the issue concerning the access to justice in Brazil, in the construction of the idea and practice of citizenship, beyond the liberal mark. Challenging the modern narrative, it seeks to rebuild the tortuous paths in the citizenship construction from successive constitutional models and the historical conformation of the legal field in Brazil. Based on this, it is taken a critical look at the major institutions of the formal justice system in the current Brazilian constitutional democratic order. The choice for mapping Brazilian justice system, which reterritorializes reforms in order to increase access to justice, is the result of the perception that the scope and meaning of law are in the interface between the state and civil society and the emancipatory potential of law is linked to struggles for citizenship. Particularly, it is assumed that the criteria under which the specialized technical staffs are organized function as filters that act on the social conflicts by establishing their contours. |
