Resumo: The Brazilian system to enforce a pay money judgment against the Treasury, when it comes to debt of greater value, does not give the lender effective judicial protection when the debtor entity does not meet the payment order in the legal deadlines and forms. This work aims, using the argumentative topois of defeasibility and effectiveness of fundamental rights, propose an interpretation of unseizability that exceed the limits of public goods, in these cases where the abuse of the legitimately privileges granted to public property turns in a unacceptable shield to the implement the court conviction. We observe also that the separation powers doctrine is not violated when the Judges enforces rights legitimately proclaimed in the Constitution or Laws or by adjudication. The Judiciary must be the reactive instance to citizens against the international game of plunder, orchestrated by the still active colonialism. If the seizure of public goods do not reach their results, we propose a more elastic interpretation of the institute of the taxes offset, a contempt of court fine to the public administrator and public, as ultima ratio, the pursuit of protection of the Inter-American Court of Human Rights, in view of the flagrant violence practiced by the Brazilian state.
