Resumo: The current thesis is aiming to study the Minas Gerais Second Degree Justice and the political questions related to its own functioning since 1874 until 1897, the period that the Tribunal de Relação ultimately appeal court which existed in the provinces operated in Ouro Preto. The dissertation is based on the idea that the Judiciary Branch and its members, the magistrates, are fundamental pieces in the formation process of the Brazilian National State. Initially it contains a historical brief about Minas Gerais justice, since the creation of the first districts in the year of 1711 until the creation of the Corte Recursal Mineira in 1874 highlighting the political and legal importance of this public agency. Hereupon, this work identifies the ultimately instance judges who worked at the Tribunal de Relação of Ouro Preto and describes their social, relational and professional profile. The thesis defends that a group of elements constituted by a same ground formation, social origin and relational universe was relevant in the process of the professional ascension at the legal career, to be appointed to a chair at the legal courts and, yet, to important political development. In 1889, when the government changed from Monarchy to Republic, a change in the characters occurred, however, without any substantial changes in the action of magistrates, especially concerning the relation between the ruling elite, Judiciary Branch and Political Power
