Resumo: | The following research has as its subject matter a systematic study of how the collective suits has been understood in the protection of collective and transindividual rights in Brazil, in order to verify its effectiveness in light of the Constitution of 1988. First, we seek to make a critical analysis of the objective reality of the treatment given to this right in Brazil given its legal construction, jurisprudence and doctrine.Then, we intend to address what contributions Hegel's Theory of Recognition and Gadamer's Philosophical Hermeneutics may give to the Collective suits rights. In short, the objective is to demonstrate that the Brazilian Legal System still uses scarcely this important tool for the protection of collective rights, so therefore we are able to point to prospects and viable solutions, based on the Theory of Recognition and Philosophical Hermeneutics, which are capable of increasing the effectiveness of collective and transindividual rights through the instrumentality of the Collective suits and access to a just legal order. |
