Resumo: This study aims to investigate the regulatory, political and legal challenges to the development of renewable energy from ocean sources in Brazil, identifying barriers to introducing this type of generation, taking into account the current legal framework, making a parallel with countries at a more advanced stage of maturity both in terms of technology as well as industrial development policies and to encourage oceanic resources. This research explores the records of the potential of marine energy on Brazilian coast for generation of electricity, considering environmental, regulatory, infrastructure and financial constraints. It also highlights the progress and technological challenges relevant to the economic feasibility for the development of an industry-based and long-term sustainability. From the compilation and analysis of data and experience from various countries in the world and the concatenation of the most successful models, it presents a projection on a timeline which establishes a relationship between the development of the market of oceanic generation and the inclusion of new public policies.
