Políticas públicas brasileiras de acolhimento dos refugiados ambientais: há respeito à sua integridade pessoal?

Resumo: Contemporary humanity experiences numerous catastrophes resulting from climate change and its consequences, which are derived (directly or indirectly) from anthropogenic action far from sustainable alternatives, causing, in a given community, region or country, the impossibility of populations staying in that location. In this sense, the problem of the research is to verify if the Brazilian public reception policies respect (or not) the personal integrity, as part of the principle of human dignity, of environmental refugees, that is, those who are forced to move due to these disasters. As an objective, it will analyze the catastrophic environmental events and the populations that forcibly displaced them. As a methodological path, an integrative bibliographical review will be used from a bibliographical survey, in a decolonial perspective, whose works were published in events and platforms such as Google Scholar, Scielo and Digital Library of Theses and Dissertations and the statistical data coming from governmental and private websites and updated news from the media, together with the documental procedure and the hypothetical-deductive method, aiming to build an interdisciplinary and forceful foundation. As chapters of theoretical reference, in the first, preliminary considerations on refuge will be addressed; the international movement of people throughout history; a historical- social overview of migrations in Latin America; the records and considerations of migrant Brazil and the current Brazilian legislation pertinent to the subject. The second will deal specifically with environmental refugees, the legal understanding about them and one of the biggest catastrophes that occurred in Brazil: the fires that devastated more than 39 million square kilometers of the area corresponding to the Pantanal during the year 2020. It will be in the Brazilian public policies of reception pertinent to the environmental refugees and the successful international and national initiatives related to the objective of this research. To draw a parallel between what was found between literature and data, the results analysis chapter will demonstrate that the policies developed, until the present moment, need to be given permanently, created from laws and not only for crisis management. In conclusion, this research is expected to propose reflections on the subject and the socioeconomic and legal consequences generated.
