The present study, essentially bibliographic, aims to understand the cultural and ideological pro cesses of the capitalist bourgeois society, in which a contemporary crisis in thehumanity’s forma tive process emerges. The study is conducted under the analytical aegis of the Critical Theory of the Frankfurt School, specifically the thinkers Theodor Adorno (1903–1969) and Max Horkheimer (1895–1973). According to the theoretical basis, the comprehension pursuesunderstanding the limitations that exist in the process of a critical, humanistic, fair and emancipatory education in bourgeois society, whose present ideology as an ideal of and in justice asserts the (im)possibility of overcoming the pseudo-formation. The research unfolded in four chapters. The first one intends to understand the constitution of the bourgeois ideal of justice and its ideological displacement along the social and historical arc, in the light of the Critical Theory. The second chapter aims to understand if the legal principiology expresses ideology, which makes the formation (im)possible. The third chapter intends to understand if there is influence of the cultural industry that reinforce the pseudo-formation, which with its multiple sorts restores the tradition in formation and in jus tice. The forth chapter leans the eyes over the Critical Theory and Education seeking to understand the obstacles imposed by rationality as ideology and the (im)possibility of overcoming pseudo formation.
