Os direitos reprodutivos no Brasil: direito fundamental ao planejamento familiar ou projeto de nação?

Resumo: | The present paper aims to analyse the form which the reproductive rights were constituted in Brazil, and to answer three questions: if the territorial extension of the country were always considered as a factor to not implement contolists policies, how the Catholic Church has influenced this decisions, and, at last, how this policy making influence in the correct garancy of the reproductive and sexual rights, especially for women. For this, it was analysed, in first place, the discourses about sexuality, family and women, scientific and religious, to comprehend how this concepts were transfered to the population theories and the debates of the two most important Population Conferences in the UN system, that are object of study that follows. In the end,was analysed the way how Brazil has built this rights, through the analysis of the speechs in the Conferences and its repercussion in the brazilian law system, specially in the Constitution debates in 1987 and 1988, and the law nº 9263/96, that plots the outlines of the family planning in Brazil. The conclusion is that the religious influences were moderate in the debates, due to abortion issues, and that Brazil was part of a thinking context in Latin America, in which there were no problems in the population growth, due to the economical growth, but, em face of social demands, has decided to implement family planning as a right to be garanted by the State. However, this implement still is under numerous problems, reason to a serie of obstacles that still need to be surpassed to the fruition of the reproductive rigths in Brasil. |
