Resumo: After the Federal Constitution of 1988, the District Attorney´s Office consolidated its position as a permanent public institution, independent of the Legislative, Executive and Judiciary powers, in charge of, among other things, investigating any harm done to the environment and indicting the perpetrators. Likewise, with the advent of the new Federal Constitution, the environment has become a public asset for the common use of the people and essential to a good quality of life, which means that everyone is entitled to an ecologically balanced environment for the present and future generations. Since the District Attorney´s Office is part of the Government, we will analyze how one of its representatives, namely, the District Attorney, carries out his duty of protecting the environment. We aim to accomplish this by researching the number of adminitrative inquiries and environmental lawsuits filed by the District Attorney´s Office in the Judicial District of Magé, which encompasses the cities of Magé and Guapimirim in the State of Rio de Janeiro (Brazil), in the period ranging from 1991 to 1998. As a standard of comparison, we have selected the year 1994 for the sake of extending this debate by also researching all other Judicial Districts in the State of Rio de Janeiro and conducting a socio-environmental study of this region. In this paper we will discuss the relevance of the role of the District Attorney´s Office in protecting the environment and present conclusions and suggestions for improving its performance in this area based on the new roles of the District Attorney in society. The new model proposed in this paper would enable a sustained development in which economic growth and social welfare would be side by side with protection of the environment, lest there is no common future for humankind
