Análise da ADPF n° 347 e da inadequabilidade do estado de coisas inconstitucional para a efetivação dos serviços públicos: por novos protagonistas na esfera pública democrática

Resumo: The present dissertation evaluates whether the Unconstitutional State of Things (“Estado de Coisas Inconstitucional” -ECI), with the characteristics identified in the decision issued in the context of the Claims of Non-Compliance with a Fundamental Precept (Arguição de Descumprimento de Preceito Fundamental -ADPF) nº347 (decision responsible for the adoption of such institute in Brazilian legal practice) is an appropriate means to demand the improvement of the quality of public services. To do so, the study based on an inductive analysis, mediated by bibliographical and documentary research, in which the diverse characteristics of the so called “structural improvement demands” were identified, in which the Unconstitutional State of Things is a species. The study shows that these judicial manifestations have their own characteristics, depending on the country analyzed and the historical context that led to this type of manifestation by the Judiciary. After identifying these characteristics -an evaluation that allows us to understand the particularities of the ECI -the ADPF decision nº 347 was analyze in more depth, considering the problems in the use of the ECI in the Brazilian Constitutional Order. By identifying multiple obstacles, one can perceive that the judicialization of politics, through the delivery of structural improvement demands, is not the most appropriate way to solve the problem of normative omissions and institutional obstacles, since the source of these issues lies in the administrative and political sphere, so that solutions must also come from these fields. It is suggests, therefore, that the confrontation of such controversies should be achieve by giving space to greater popular participation in the decision-making processes of Public Administration. An extension that should not only occur in quantitative aspects, but, above all, qualitative.
