Resumo: The research aimed to analyze, in the context of the transformations in the world of work, the counter-reform of high school, over the last twenty years, which culminated in the process of proposition, processing and approval of Law n. 13,415/2017, as well as examining the links between the aforementioned Law and the main legal provisions that give organicity to the so-called “new” high school, namely: the BNCC and Resolution n. 3/2018.To this end, the study is based on historical-dialectical materialism, having as a theoretical reference, authors such as Kuenzer (2000), Zibas (2009), Krawczyk (2017), Ciavatta (2005), Nosella (1992) , Frigotto (2004), Girotto (2018), Freitas (2018a), among others. The research had a qualitative nature, carrying out an exploratory investigation of the bibliographic and documentary type around the main legal provisions that deal with the "new" high school. The results indicate that such a proposal is far from configuring a “new” Brazilian high school, showing yet another renewed edition of the old strategies used for decades in the country, delaying the advances made towards an emancipatory education for the children of the working class. To conclude, it is proposed to make efforts from the whole of organized civil society to demand that the State adopt an educational policy that is truly capable of expanding opportunities for access and permanence to quality Basic Education for all at all stages of the teaching.
