Resumo: It analyzes issues involving the fine for contempt of court (astreinte) under the fundamental right to the effectiveness of the process. It proposes a method of interpretation of the law focused on the duty of the judge to face all the arguments put forward for discussion by the litigants with special relevance to the consistency of judgments. It analyzes the content of some fundamental procedural rights. It examines the concept, the function, and the historical aspects of the fine for contempt of court. It analyzes legal provision of the fine for contempt of court in Brazil and its legal nature. It exposes and criticizes the main arguments used to allocate credit of the fine for contempt of court to the author or to the Treasury. It analyzes the feasibility of the fine the fine for contempt of court directly against the Treasury and directly against the public officer. It exposes and criticizes the precedente of the Superior Court of Justice on the matter. It proposes criteria for setting and modifying the value of the fine for contempt of court by the judge. It analyze and review the requirements for enforcement of the total amount of the fine for contempt of court, including proceeding, defendant's rights and the relation between the decision imposing the fine for contempt of court and the final decision of the case.
