Resumo: The world war II impinged radical transformations upon the global order, so that reflections about humanitarian principles and ideals began to happen universally. Thus, ideas about democracy and fundamental human rights became stronger and a new thought on constitutionalism came up. Nations began undergo redemocratization and institutions were rebuilt and, as a result of this, Judicial Power was given a new role. In this context, Judicial Power started off an active participation in building a democratic environment and, thus, strongly intervening in political processes of decision under the majority rule. So, the socalled judicial activism comes up. However, it demands a profound analysis of concepts such as constitutional jurisdiction, constitutional interpretation as a requirement for a better understanding of its real meaning. The term brings doubts and disputes out and it is used in an inaccurate way and it is often linked to other controversial term: judicialization of politics. It is a certainty that a refinement of the phenomenon ontological understanding improves the judiciary action in an interactive way with the other branches, in a higher perspective of fundamental human rights accomplishments and consolidation of the democratic ideal.
