Social Control, in the modern sense of control of state actions by civil society, is a form of exercise of power by the citizen. However you cannot control what you have no information about. The SC of 88 was enacted as a result of intense demands from civil society in the context of the redemocratization and reopening of the Brazilian state. The public administration's transparency agenda has grown, driving the liberal reforms of the new management. In this context, the Law on Access to Information (LAI) was enacted in 2011, establishing the access regime. LAI has as its guidelines advertising as a rule and confidentiality as an exception, disclosure of information regardless of requirements, the use of information technology, and the ultimate goal, the development of public transparency and social control. From the perspective of the Fourth Generation Assessment together with a cut from the Depth of Public Policy Assessment perspective, this research aimed to evaluate the applicability of LAI from the perspective of its beneficiaries in light of its IFCE Campus Fortaleza guidelines. Specific objectives: (i) to understand LAI in the context of the evolution of Brazilian Public Administration and Social Control; (ii) verify compliance with the Active and Passive Transparency requirements; and (iii) evaluate LAI from the perception of its beneficiaries in the IFCE Campus Fortaleza. A bibliographic and documentary research was carried out and questionnaires with closed and open questions were applied treated by Bardin's Content Analysis (2009). Investigating the application of public policy beyond mere compliance with legal provisions is crucial. It is vital to note whether the beneficiaries, who are on the cutting edge of the law, understand the right vested in them and whether it actually serves as an instrument of power for the citizen. It was observed that the core entity of this case study currently does not meet all legal requirements and also does not promote transparency and social control advocated by LAI. In the end, beneficiaries have little or no knowledge about what social control is over public administration. |
