Resumo: The growth and development of children are naturally influenced by environmental and nutritional factors that intensify this critical phase of childhood. Nutrition, key factor in the health of that individual, can have repercussions throughout adulthood, especially in cases of hospitalization. It demonstrates the close relationship between economic growth and development and the guarantee of the recognition of children as subjects of law that requires full protection and especially for their particular condition. While hospitalized, should receive a healthy and quality food, including from the sanitary point of view, with healthy and safe food, free from physical, chemical and biological danger. The hospital, as a public agent, has the duty to promote Food Security and the Human Right to Adequate Food in all its dimensions, involving factors such as quality of food and good production conditions, ensuring the protection and rehabilitation of children who use of its services, offering a milk dispensary unit with appropriate facilities and functional, capable of producing milk formulations under strict sanitary conditions. Given the importance of the subject, aimed to investigate the adequacy of the sanitary conditions of milk kitchens from public hospitals in the state of Alagoas according to the recommendations of RDC nº 63 of 2000, considering the principle that full compliance with the recommendations is a fundamental condition for ensure the DHAA to hospitalized children. The dissertation is divided in two parts: the first includes a literature review on the subject of recognition of children as subjects of law and respect and the relation of the indivisibility of rights with the SAN in the regulation of milk dispensary, in order to develop safe food. The second is the presentation of an original article, which resulted of a survey on the sanitary conditions of public hospitals in the state of Alagoas. We applied a checklist of 86 essential items grouped into three blocks on Structure, Human Resources and Organizational Conditions. The adequacies of the milk kitchens were identified in accordance with the potential risk of legal standards, and must reach 100% of the items.
