Resumo: This essay analyzes the legal discourse that is materialized in the text of the law and in the official documents of the State on the imprisoned woman and the payment of her sentence. Therefore, we seek theoretical framework on Discourse Analysis (DA) of the French line and pecheutian aspect, allowing a discursive analysis of materialist basis, which considers the real history and language as socio-historical object. We seek foundation in the work developed by Orlandi, beyond Marx’s, Lukacs’ and Mészáros’ texts. From this theoretical perspective, it seems that in the historical processuality in which is said of the imprisoned woman, there are contradictions that reflect the gap between the law and the daily life of prisons, besides the class and gender inequalities that constitute the capitalist society. From the objectivity of solid social relations and productions related to the object, the corpus of this research consisted of extracted materialities from the following official documents: Criminal Enforcement Law (1984), Regulation of the Penitentiary System of the State of Alagoas (2000) and the Primer Imprisoned Women (2011). Thus, considering the relationship between ideology, history and subject, this essay reveals the meaning effects of legal discourse (re)produced in those official documents intended not only for the application of a penalty and the establishment of an order, but for the penalty’s place and form that the woman in seclusion situation is submitted.
