Resumo: This research aims to understand the process of institutionalization of public policies focused on the theme of local development, analyzing the main legal frameworks that surrounded these policies, emphasizing the contradictions intrinsic to them from the theoretical model of historical institutionalism. From the previous theoretical observation on development at the local scale, it can be observed that the brazilian municipalities, within the perspective of a global capitalism, have difficulties of economic growth and guarantee of good quality of life for its population. Therefore, the objective of the research is to investigate the process of institutionalization of local development in Brazil, starting with the 1988’s Constitution. Considering that the discussions on public policies of local development have gained strength in recent years, the present work intends to critically analyze socioeconomic development policies based on the theory of endogenous development.In conclusion, we observe that local development, inserted in a national development project, has characteristics that can contribute to economic growth aligned to the quality of life. However, its appropriation from the mainstream perspective distorts the proposal of development from the local actors, which creates a mismatch between the project and its application.
