Resumo: This thesis aims to analyze the extent to which the family institution is an important factor contributing to understand and to prevent the youth crime in Brazil and what are the consequences of a missing family towards its parental duties in the biopsychosocial development of young people in conflict with the law. This research is based on the collection and analysis of data abtained in the survey conducted during the month of September, 2011, with the charts of 54 adolescents that are sentenced to social hospitalization in the Centro de Atendimento Socioeducativo de Passo Fundo (CASE-PF). Based on the research, it can be said that the detainees have practiced out of law actions when they were 17 years old, that they have low education, that they have friends who have committed illegal acts and that they are detainees due to theft or robbery. All of this, according to this research, has been doing due to the necessity of sustaining their state of drug addiction, especially crack. Through analysis of the families of these adolescents, this paper has shown troubled family relationships: parents missing their functions, with low education, involved in crimes, users of psychoactive substances and aggressive people. The juvenile detainees did not have active participation of their father in their biopsychosocial development and live in deficient households, in which they have not experienced notions of boundaries (limits) due to the non-presence of this (father) figure. Thus, if a family does not practice its parental functions, it provides a poor biopsychosocial development, which may be intensified by the failure of other social institutions that do not succeed in their tasks, making the formation of personality of such a group even worse and making it easier for anti-social behaviors take place. The family institution organizes the transmission of cultural values by means of affections and by the imposition of boundaries. Though, this transmission fails regarding adolescents which are in conflict with the law
