Resumo: This dissertation deals with the issue of socio-educational measures in an open environment and the relationship with the legalization of violence in schools. This study was conducted at the Serviço de Execução de Medidas Socioeducativas em Meio Aberto, running in nine CREAS of Porto Alegre, RS. The school has been constantly experiencing and managing the conflicts generated by different forms of violence. It is in this context that the judicialization of violence that are expressed in schools deemed illegal acts committed by teenagers in the school environment, and that impact on educational measures. Given this, the study intended to analyze how social and educational measures in an open environment are facing the issue of violence in schools that judicialization, aiming to contribute to ensuring the rights of children in conflict with the law. From this study it was possible to know the trajectory of adolescents in fulfillment of educational measures in an open environment that experienced violence in schools that judicialization meet the multiple aspects that led to the legalization of school violence and the fulfillment of educational measures in an open environment; show relations between these young people and schools, and to identify possible effects of educational measures in open face violence at school and in securing rights, especially the right to education. The study was a descriptive, qualitative and grounded in critical-dialectical method, using techniques such as bibliographic and documentary research and semi-structured interview. Research participants were 5 teens, 6 families, 7 leader socio workers and 7 guides socio workers, a total sample of 25 subjects. The interpretation of the data was performed by Discursive Textual Analysis, based on studies of Roque Moraes. It was possible to identify the various determinations that contribute to the legalization of school violence and the fulfillment of socio-educational measures such as: poverty, violence structural, institutional and symbolic; exclusion, discrimination, emptying pedagogical activities and school authority; processes of selectivity and criminalization of poverty. It was evident that the legalization of school violence is embedded in a process that encompasses the channeling of conflicts and situations of violence occurring in the school for the Justice System, implying the delegation of responsibilities of the school to the sphere of the judiciary and consequent processes of exclusion and discrimination, which ultimately impact on truancy and school dropout. However, there are schools that have initiatives aimed at confronting these issues, which, through awareness, dialogue, restorative practices and culture of peace, perform mediation and resolution of such situations face police intervention and judicialization. It was observed that the five teenagers interviewed, two are out of school, signaling the fragility of public policies to ensure the realization of human rights, especially the right to education. In this sense, it is necessary to strengthen the relationship between the socio-political and education policy, and the joint between intersectionality and other public policies in order to guarantee and realization of human rights of children in conflict with the law.
