This Thesis investigates the possibility of carrying out on-line the discursive practice of morals in the democratic rule of law. In the development of the theme to face the problem, two themes are approached, the Network and the Discourse, with the purpose of verifying the possibility, in theory, of carrying out the discursive practice of morality on-line. The internet, as one of the Technologies information and communication (ICT), changed the structures of society and gave rise to another modality of social sphere, showing that the use of new technologies gradu-ally originates a new environment that configures and controls the proportion and form of hu-man actions and associations. It is, then, in this new social environment of the democratic State of law, that is, in the network society, with its positive and negative effects, that the possibility of the “online” realization of the discursive practice of morality is investigated, with the scope of obtaining the consent of those concerned about problems or moral conflicts existing in con-temporary society, specifically, as an "online" procedure for examining the validity of proposed and hypothetically considered norms, aimed at establishing universal moral action. The Theory of Communicative Action developed by Jürgen Habermas is an anticipation of the presentation of the Discourse Ethics project, whose debate took place in mid-1973, based on a work in which Karl-Otto Apel explained about the transcendental and pragmatic transformation of philosophy and addressed the issue of “the a priori of the communication community and the foundations of ethics”, as a presupposition for the practice of argumentation. Jürgen Habermas continued with the development of this project and, highlighting his differences from the proposal once made by Karl-Otto Apel, he formulated the work “programmatic notes for the foundation of an ethics of discourse”, in which he presented his proposal for structuring the foundation of an ethics from a discursive procedure. It is important to emphasize that the origin of the elaboration of Discourse ethics is a result of the effort and mutual debate by philosophers Karl-Otto Apel and Jürgen Habermas. Thus, having developed these subjects, a proposal is presented about the possibility, in theory, of the “online” realization of the discursive practice of morality in order to, through a communicative action, obtain consensus regarding the validity of norms and com-mandments. |
