Resumo: The use of arbitration in Brazil experiences a large growth, as it also happens in many other countries that accept the arbitration as a form of dispute resolution. The present study analyses the use of arbitration in class litigation, that is to say, the type of litigation focused on diffuse, collective (stricto sensu) and homogeneous individual rights. From an analysis of the nature of these positions, according to our legal system, one can conclude that the homogeneous individual rights, as a general rule, fulfills the arbitrability requeriments in Brazilian law. On the other hand, once again according to Brazilian law, the arbitrability of the diffuse and collective (stricto sensu) rights, as a general rule, have a narrower scope, limited to the ways in which the obligation that is being discussed in the lawsuit is performed by the debtor. Finally, the procedural solutions are analyzed, as a way to make possible the commencement and administration of a class arbitration in Brazil.
