Resumo: This work studies the question of the cooperation and the joint liability among the Federal Members (Federal, State and Municipal Government) in right to health and it aims to answer what is the connection between the cooperation and the joint liability s jurisprudence and what the Federal Members must look for in this context. This study includes a review of the literature and of the researches and also a quantitative study of Supremo Tribunal Federal s decisions. This quantitative study is linked with a qualitative perspective that includes jurisprudence of Supremo Tribunal Federal, Superior Tribunal de Justiça, Tribunal Regional Federal da 4ª Região and Tribunal de Justiça do Rio Grande do Sul. This work also includes a review of general and specific rules which regulate this area and of budget data of Twenty- ninth Constitutional Amendment. The results of this study suggest that the new rules have increased the demand for cooperation and this growth can to be seen as an answer to a problem. Other important find is that the joint action is a basis for cooperation. It makes the cooperation possible and makes the cooperation to produce better results. On the other hand, it is also needed a solid performance of the state. This performance includes the cooperation, and for cooperation is required, in addition to political will, good management of the resources and of the health care. The divergences related to the application of the minimum resources in health, and data audits, suggest problems in these fields. For that reason, the joint liability reaffirms the law. If the Federal Members do not have a joint and solid performance, this premise becomes visible at the time of litigation as the joint liability.
