With scientific and technological evolution, new products are eveloped, without the possibility of previously knowing the full extent of their risks, considering the state of knowledge at the time they are introduced in the consumer market. In this scenario, the current consumer society is inserted, characterized by unpredictability, uncertainty and insecurity regarding the intensity and inevitability of the risks to which consumers are exposed. With this, the consumer - a vulnerable part of the consumer relationship - emerges an expectation of security in relation to products circulating on the market, based on the idea of trust, justifying the need to protect such legitimate interests. As a result, the concern with development risks is current, with the need to discuss its application in the brazilian legal system as a cause of exclusion or attribution of civil liability of the manufacturer. Therefore, this research seeks to answer this question from a doctrinal and jurisprudential study, especially with regard to the risk of insecurity in the research of medicines, such as remedies and vaccines, in order to suggest a viable alternative to live with the risks, in order to harmonize the interests of the participants in consumer relations, making consumer protection compatible with the need for economic and technological development. |
