Resumo: The object of this study is the question of the validity of the right by asking that the law is effectively. This is an ontological question. Only through a reflection on the validity of the right you can get a definition that has a positive content. The right is a matter of supply and not merit. The method used was the description, analysis and comparison of arguments between jusmoralistas theories and positivist theories that make up the theoretical foundation used. The approach of legal positivism in Brazil is deficient, made caricatured, without reference to seminal works and world discussed. In order to alleviate this deficit, this research seeks to clarify the theoretical controversy between legal positivism strictly sensu and the jusmoralismo. In addition, keeping the essential difference between legal philosophy and legal theory, this research aims to expand the contents of strictly sensu positivist theory. The thesis presents as a contribution to updating and contextualizing the legal strictly sensu positivism with normative positivism.
