A ação civil pública no processo do trabalho como principal instrumento judicial de aplicação imediata dos direitos fundamentais dos trabalhadores

Resumo: The Public Civil Action has its origin in ancient Roman class action, since ancient times had the opportunity to defend the goods interests of the community. The Labor Law has evolved since the beginning of humanity, requiring the procedural instruments being updated in order to meet more dramatically Brazilians citizens. Seeking to generate efficiency and effectiveness rights, individual-meta analysis (diffuse rights, collective stricto sensus and homogenic individuals), which considers the doctrine of modern system comes collectivelly access to justice. Public-interest Civil Action, in general, is an object of individual-meta analysis rights, in order to serve the public interest proposing such procedural requirement, the so-called Public Prosecutor s Office. Alike the judiciary s labor, but with a focus on individual-meta analysis rights of workers and, with active legitimacy of parquet labor. In the Federal Constitution, Brazil grants vast opening of fundamental rights conferred to its workers. Procedural instruments of collective protection of the rights of workers, appears in the Civil Action, having in mind that the sentence pronounced on this, demands can benefit a big number of destinataries of postulated rights. One of the major means of immediate application of Workres Fundamental Rights, based on the principle of duration of the process.
