This work presents the analysis of two models of legal regulation of regulated services in Brazil: the regulation by the Agência Nacional de Saúde Suplementar - ANS and the consumer codified protection. In the study of these topics, defends the thesis of a sustainable social regulation, considering the possibility of systemic balance in the context of fundamental rights, since the model code of Consumer constitutes a normative reference that radiates from the Constitution, guidelines for consumer protection that should be reflected in all consumer relations. The sustainable social regulation seeks to promote balance between consumer protection - the agency acts with popular participation - and the interests of companies and insurance plans supplemental health care - in view of its economic support in the market - so effect to the principle which is engraved on the standard of Article 4 III of the Code of Consumer Protection, which establishes the harmonization of the interests of participants of the consumer protection consumer relations and compliance with the need for economic and technological development, in order to allow the principles on which is based the economic order (according to the norm of Art. 170 of the Federal Constitution), always based on good faith and balance between consumers and suppliers, from the national policy of consumer relations |
