This paper aims to analyze some aspects that permeate the production of evidence in court proceedings that deal with themes related to the environment, especially analyzing three techniques that contribute greatly to a proper outcome of the evidentiary context. Analyzing the topics of instructive powers of the judge, the rules for distributing the burden of proof, and the technique of reducing the test module, the study attempted to identify mechanisms that assist in overcoming the obstacles imposed probation on the parties to labors whose subject is highly complex and shrouded in so much uncertainty, as are the vast majority of cases that discuss environmental issues, for its continuity in time and impact on future generations. All this to ensure the access to justice of the author, which is possible only when it has access to the necessary evidence to prove their claims, as to ensure the not less important right of defense of the defendant. |
