Resumo: According to the principle of territoriality, the power of taxation on non-residents by a certain State only can be materialized when the taxable event is normatively bounded to its law. The incomes obtained from foreign direct investments in Brazil are submitted to two systems of taxation, which vary according to the level of penetration of the corporate entity in the national economy: analytical, isolated taxation, when the non-resident does not operate through a permanent establishment, or, when he does, the income is earned by an independent form; and compositive, applicable in the other cases, which makes the taxation comprehend only the results at year-end according to the bookkeeping. As to the economic aspect of the foreign investments, the Federal Constitution, article 172, establishes that the law will discipline, always based on the national interest , the investments of foreign capital, encouraging the reinvestments, and ruling the remittance of profits. Being located on the Chapter I The General Principles of the Economic Activity , as part of the Title VII The Economic and Finance Order , this precept receives direct influence of the article 170 on its interpretation, which, although recognizes the capitalist system of production, prescribes that the economic activity has the objective to ensure to all an dignified existence, according to the precepts of social justice
