Resumo: The present work aims to investigate, from an interdisciplinary perspective, the problem of the exercise of criminal investigation prior to the filing of a complaint by non-police institutions and the Public Ministry. For this purpose, bibliographic research is used as a methodology. It begins by presenting the relevance of the problem on the present moment. In such effort, a legal study of the matter is developed, based on the highest values of the Democratic Rule of Law and the defense of the fundamental rights of the investigated Then, a sociological study is carried out on the postmodern vectors that drive this institutional movement towards the performance of the investigative activity. It then proceeds to an analysis of the issue from the perspective of Psychology and Neuroscience, focusing on the study of cognitive biases and the right to proper cognition in criminal investigation. Finally, the main points are brought together, summarized in a conclusion for the non-possibility of investigation by non-police institutions or by the Public Ministry
