Resumo: This thesis aims to investigate the issue of nationality as a factor that enhances migratory selectivity on Nation-State. Fundamental aspects of nationality are analyzed, based to the international legal framework. The elements of the nation-state are also the object of research that aims to understand the raising of State on modernity. A brief historical overview of the main documents that enabled the advancement of rights protection is outlined. In the Brazilian context, the legal provision of nationality is developed from constitutional history until the promulgation of the Federal Constitution (1988), outlining the legal limits of native and naturalized. The Brazilian national and local migration panorama is presented, with an analysis of the main legislation since the Foreigner Statute. Three cases are studied: Cláudia Sobral (STF), Nottebohm (ICJ) and the case of Brazilian border closures during the pandemic. Was used the hypothetical-deductive methodology as theoretical reference, Donatela Di Cesare, Hannah Arendt, Eric Hobsbawm and other authors from the social sciences and international relations
