The Federal Constitution promulgated in 1988 offers copyright and fundamental rights to Brazilians in order to enforce or respect the dignity of the human person in the Democratic State of Law, ensuring the promotion of values such as use and justice for national development. In this Doctoral Thesis in Social Sciences, we seek to study the serious situation caused by the epidemic of MICROCEPHALIA that mainly affected a population in the Northeast of Brazil, a region with less favored social classes and historically excluded from Brazilian society. We carry out field research visiting cities in Pernambuco. In them, we interviewed mothers who have their children with microcephaly, seeking to understand the routine and medical monitoring. Note how great it is for these families to provide their children or the minimum necessary before their daily difficulties. A field research also revealed the inability of the Brazilian State to treat patients with microcephaly. This framework problematizes the effectiveness of compliance with constitutional guarantees, becoming one of the problems analyzed by those who are not conclusive, but collaborative, to the point of helping or debating the scope of public welfare policies in the Brazilian Magna Carta |
