Considering the many technological innovations of the Twentieth Century that act directly on information and communication, the Internet in particular has directly influenced man and society, so that the access to the Net has become a necessity of our time and was declared by the UN as a human right. Thus, this research aims to examine the legal nature of Internet access and investigate whether is possible consider it as a new human right related to information technologies. While developing this study result of bibliographic, normative and jurisprudential analysis essential aspects were addressed human rights, Internet s relevance for Human Rights, followed by concluding remarks on access. As a result, it is concluded that the Internet is not just the technical definition of a data transmission network, nor it is only a communication means, it has become a true locus where all men should have the possibility to live and participate in community life. Therefore, the right to Internet access goes beyond the mere access to the necessary infrastructure to get connected, has incorporated access to all content and training or digital literacy. We are dealing with a Human Right, an ideal requirement that every individual and all mankind can be recognized as a person in this new social space |
