This dissertation analyzes the principles, elements, and legal hermeneutics applied to contracts, emphasizing mutual contracts and their particularities and highlighting jurisprudential interpretation in the Brazilian scenario. The study begins with discussing the general theory of contracts, covering fundamental concepts, legal nature, guiding principles, essential elements, and the effects of agreed obligations. It then explores the specificities of the mutual contract, especially the high-yield mutual, and examines the application of legal hermeneutics in these contexts. The dissertation focuses on understanding how courts interpret and apply contractual clauses in loan cases, providing a critical analysis of judicial deliberations. The main objectives of this work focus on deepening the knowledge of the theoretical foundations of contractual theory, differentiating loan contracts from lending, investigating the application of legal hermeneutics in loan contracts, and identifying the particularities of the high-yield mutual in the context of judicial decisions. The method used was based on bibliographic and documentary research, covering doctrines, legislation, and judgments of higher courts. The conclusions reveal the complexity in the interpretation of loan contracts, highlighting the importance of hermeneutics to ensure the fair and balanced application of contractual clauses. Therefore, the work contributes to offering a comprehensive integration between theory, practice, and jurisprudence and reinforces the relevance of legal interpretation in promoting equity in contractual relationships |
