Resumo: This paper aims to analyze environmental public policies, with a theoretical and practical approach, as means to guarantee the fundamental right to an ecologically balanced environment. Based on the consolidation and relevance of environmental protection in the national and international contexts, the paper aims to contribute to the theoretical deepening of the theme of environmental public policies, as an alternative opposed to the command and control instruments, primarily adopted by environmental public institutions for the purpose of environmental protection. It is adopted as theoretical reference, the analyses on public policies in general, developed under the scope of Political Sciences, in order to define the essential elements, the cycle of public policies, and the intrinsic challenges to be faced for effective implementation. Its conclusion lies towards the favorable potential of environmental public policies to guarantee the fundamental right to an ecologically balanced environment; it also proposes the concept of environmental public policies and the extrinsic challenges to be faced in this specific area are analyzed. Considering the analysis of examples, the theoretical concepts raised are evaluated in the context of practical application of environmental public policies, granting a degree of comparability for better identification of its essential elements, main ideas and corresponding implementation cycles. Besides briefly analyzed examples, the examples of environmental compensation and conversion of environmental fines are addressed in more details, such as mechanisms originated from the command and control instruments, and subject to the implementation of environmental public policies in order to achieve positive action for environmental preservation, improvement and recovery, generating the effect of guaranteeing the fundamental right to an ecologically balanced environment
