Resumo: This paper analyzes the duty to mitigate the loss in relation to consumer’s conducts. The mitigation of losses reflects the idea that the creditor must make reasonable efforts to avoid worsening the damage resulting from debtor’s default, under penalty of not being compensated for such damage. This paper analyzes if – and to what extent – it is possible and reasonable to require that consumers, as the vulnerable party in consumer relations, adopt certain measures to mitigate their own losses. This paper starts with a brief analysis of the Brazilian Consumer Protection Code and the guiding principles of consumer relations, analyzing the mitigation of losses as implemented in Brazil and, particularly, its compatibility with the principles of the referred code, as well as the relevance of its application. Then, this paper addresses the particularities and limitations of the duty to mitigate the loss applicable to consumers’ conducts. At the end, it is understood that the mitigation of damages should be required from consumers, being compatible with the principles applicable to consumer relations. Nevertheless, the application of the institute requires caution, with the detailed analysis of the particularities of each case and, especially, the characteristics of the parties involved
