The objective of this Doctoral thesis is to study the new national curricular guidelines for the graduation, bachelorship in Law. The new national curricular guidelines have been established for the juridical teaching by the Higher Education Board of the National Education Council CES/CNE, under the Resolution № 9 of the 29th of September, 2004. This study originates from the teaching experience in higher education as Professor and Coordinator of Juridical Practice Nucleus in the Law course. More specifically, it seeks to analyze: a) the ways of carrying out the interdisciplinarity established in item IV, § 1, art. 2 of the Resolution CES/CNE № 9/2004; b) The implanting procedures and the curricular structure of the Juridical Practice Nucleus to which refers item IX, § 1, art. 2 of the Resolution no 9/2004, based on the analysis of a Juridical Practice Nucleus of the Faculdade de Direito da Universidade Cruzeiro do Sul UNICSUL, which is used as a study of case for this work; c) the forms of integration between theory and practice, determined in the art. 2, item V, of the Resolution CES/CNE nr. 9/2004. Although the curricular issue is not something new to the Education Science, it resents the absence of the Juridical Science approach. In this sense, the focus of this study is of methodological interdisciplinary and transdisciplinary character, in active connection with the Science of Education, with Pedagogy, with Philosophy and Philosophy of Law. Concerning Philosophy of Law, the study presents, as theoretical reference, the thinking of Jacques Derrida whose deconstruction of law and justice concept lays the foundation for research and the thinking of Paulo Freire on Education. The thesis defends that the creation of these new curricular guidelines for the Law course must not constitute a mere closed, stagnant, permanent, immutable and finished normative construction normativity and prescriptability constitute just one of its dimensions. It is therefore proposed a new curricular configuration based on Juridical Education, aiming at ethical and honorable education. Dedicated also to tolerance, respect for the differences and human dignity, solidarity and humanism; curriculum commitment towards juridical education quality, towards an effective construction of citizenship, imposing, consequently, a change in the posture of the maintainers of the IES, of the teachers, of the professors, and of the students; change that by far surpasses the exclusively positive and dogmatic thinking in the application of Law and Justice |
