Resumo: This research aims to analyze preventive detention, as a personal precautionary measure, its compatibility with fundamental rights and guarantees, mainly fixed and abstracted from the Federal Constitution, without forgetting the discussion about its instrumental function aimed at protecting the process in question. itself, also, its usefulness in protecting society. This is because in the reform introduced in the Code of Criminal Procedure - first, by Law No. 12.403, of May 4, 2011, then reinforced by Law No. 13.964, of December 24, 2019 -, the provisional arrest ended up being relegated to the ultima ratio, lo that the primacy of other precautionary measures other than prison was established, regarding procedural caution. Previously, from the constitutional point of view of the principle of no guilt or innocence, in the doctrine, there was an understanding contrary to any form of imprisonment prior to the final sentence. another, partially favorable, provided that the custody was of a truly precautionary nature and aimed at protecting the process, that is, aimed at carrying out the criminal instruction and preventing the accused's escape; majority, the last current accepted prison within the dictates of procedural law, in order to also accept its social protective purpose. In this scenario, it is necessary to investigate the current doctrinal position, regarding the anticipated prison effect, in light of the essential human rights of those involved in the process, to point out harmonizing interpretations and alternatives for the use of a prison precautionary measure inserted in a context of constitutional criminal procedural law
