Resumo: |
The objective of this academic paper is to discuss the new concepts of family and to expose the social security protection concerning them. Also, it intends to elucidate the types of plural relationships and to portray the legislative and judicial omission in the General Social Welfare Regime on this subject. This way, based on familiar structures and mainly on the concepts of Social Security Law, a study will be carried out about the granted benefits to the dependents of the regime's insured users, focusing on the concepts of spouse and male / female partner, in order to reach particularly the components of polyamory relationships. In addition, the founding principles of the Federal Constitution are explored in a general and specific way, until it uncovers the existent prejudices and social discriminations against polyamorists. Beyond that, there is discussion about the points of disagreement regarding the nonrecognition by notaries decision and the public deed in plural compositions. The purpose of the study, therefore, is the possibility of effecting social protection either by a norm, or by a judicial decision with erga omnes effect, in order to reach the ideal of social justice |
