Resumo: The objective of this study is to analyze the civil responsibility of the judge for procedural errors under the constitutional aspect and the phenomenon of the vertical integration of the constitutional norms that were reflected in the Code of Civil Procedure of 2015. The institute of civil responsibility is treated in the beginning in order to demonstrate that its current understanding can not exclude the State judge from indemnifying the damages caused by the exercise of the jurisdictional activity. The doctrinal and jurisprudential obstacles adopted by the Brazilian Federal Supreme Court are removed, with arguments that were only justified under previous constitutions. The current constitutional system provides for compensation in case of a judicial error and if the convicted person is arrested beyond the time fixed in sentence. It is also analyzed whether this responsibility is subjective or objective. Finally, we try to identify the error of the judge in the conduct of the process that translates into offending minimum procedural guarantees. If these rules of conduct are not obeyed and the other requirements for objective reparation are present, it will be for the State to indemnify the jurisdiction and may require the judge to act in a regressive manner if the latter has acted with intent or fault
