This dissertation analyzes the governance of Artificial Intelligence (AI) to safeguard privacy, data protection, and informational self-determination. It begins by highlighting the importance of comparative law for a better understanding of the topic. The study then explores the rights of personality, covering their historical evolution, foundation, nature, characteristics, and relation to human dignity. It also examines the right to privacy, detailing its origin, concept, delimitation challenges, current system, and its connection to the right to freedom and private autonomy. The focus is on the right to data protection and AI governance for protecting personality rights. The dissertation reviews the evolution of data protection legislation, its independence from privacy rights, and its recognition as a personality right based on classic characteristics. It also addresses ethical and regulatory challenges of AI, comparing European and North American governance models and analyzing Brazilian legislative proposals, especially Bill 2338/2023. Finally, it discusses legal mechanisms for data protection that contribute to comprehensive personality protection. The research methodology is qualitative, using bibliographic and documentary sources. The research is descriptive and exploratory, aiming to develop ideas based on the topic. It is concluded that AI governance can be structured effectively through the integration of specific regulations and flexible guidelines, aligned with international best practices and adapted to the Brazilian reality. This approach, combined with active participation in global initiatives, can ensure the protection of privacy, personal data, and informational self-determination, while promoting technological innovation and the legal certainty necessary for the sustainable development of AI in Brazil |
