This study investigates the expatriation of Brazilian workers in light of the 2017 Labor Reform (Law 13,467), analyzing the legal implications, benefits, and challenges inherent in this practice. The aim is to comprehend the legal possibilities of international transfer, the effects on employment contracts in Brazil, and the current interpretation by the Superior Labor Court (Tribunal Superior do Trabalho – TST). The research addresses the difficulties arising from legal uncertainty, both from a labor and fiscal perspective, emphasizing the impacts on employers and employees. Furthermore, it examines how the labor reform influences the expatriation of self-sufficient workers (“empregados hipersuficientes”), exploring the innovations introduced by Law 13,467, the good faith, and the employees’ autonomy in negotiations. The results seek to contribute to a reflection on the necessity of adapting legislation and jurisprudence to the contemporary demands of labor relations |
