The Deaf Person carries a history of deprivation, indifference, prejudice, isolation, exclusion and immeasurable human and social violations, which marks his life of struggles and merits for values of respect, freedom and human dignity to his reality. The resignification of deafness from the aspect of “disability” to the conception of expressing “difference” as “one of the ways of being in the world”, especially contemplated in the UN Convention on the Rights of Persons with Disabilities in 2007, as well as Disability Statute in 2015 represents the evolution. In the Brazilian social context, Deaf People punctuated by Decree nº 5.626/2005, and thus users of the Brazilian Sign Language - LIBRAS, recognized in Brazil through Law nº 10.436/2002, have faced communication barriers that make it difficult or impossible for them to participate fully in the exercise of citizenship, due to their linguistic uniqueness and the lack of mastery of the two languages by Brazilians. In the midst of this divergence, international and national regulations have protected and assisted the problem, enabling accessibility mechanisms to fill the gaps. However, there are still several episodes, in intramural and extramural aspects, that maximize the reality of human vulnerability and uninterrupted failures to the effectiveness of their rights. With this, through bibliographic research, the study brings analyzes about the “(in) effectiveness” of accessibility devices, as well as the current regulations regarding the problem; addressing real situations and jurisprudence, especially the importance of the officialization, learning and use of LIBRAS, with primacy in childhood, for all as an element, not only primordial to social interactions in relation to citizenship, but also of humanitarian reason in respect to humanity, equality, non-discrimination, freedom, dignity of the human person and especially the linguistic uniqueness of the Deaf Person |
