The purpose of this dissertation aims to examine the hypothesis of a problem occurring when a will is opened: the possible existence of testamentary provisions that are susceptible to different interpretations, because, in this case, the pursuit of the testator's real intention is not a simple task, given that the will is only executed after their death, when it will no longer be possible for the testator to clarify his expression of intent. Considering this, to arrive at the answers to certain questions raised throughout this study, it is necessary to analyze, in general terms, the act of interpretation. This is because the interpretation of a text requires the interpreter to follow guiding principles, established by legal hermeneutics, to guide them to an understanding equivalent to the message the author wanted to convey. The limits of ascertaining the testator’s true intent beyond the literalness of the testamentary clauses, and whether, for the aforementioned verification, the interpreter can use evidence and external elements to the will instrument. With regard to scientific methodology, in seven chapters, the dissertation constitutes a qualitative scientific research (whose collected data provides details and depth of knowledge for a better understanding of the revealed implications), of an exploratory in nature (its emphasis is on the subjective character of the object, focusing on the study of its particularities and unique experiences) and guided by the analytical-descriptive narrative, insofar as it uses doctrine and empirical data (judgments and case law from various Brazilian states) to support the proposed discussions. The study presents practical cases and analyzes judicial decisions that centered around wills and testamentary provisions characterized by vagueness and ambiguous in their wording |
