A garantia de acesso ao Benefício de Prestação Continuada (BPC) como mecanismo de efetivação da proteção social para os refugiados no subsistema da assistência social

Resumo: Contemporary society, which is marked by several changes and some complex social transformations, faces the negative factors brought up from the evolutionary process of humanity and it observes the devastating scenario, caused by one of the greatest humanitarian and social crises of all time. Some factor, such as: wars, persecutions and repeated human rights violations are crucial to trigger the drivers of the uncontrolled growth of forced migrations, with the coerced exodus of people and the noteworthy growth in numbers of requirements for recognition of refugee conditions in different parts of the planet, it reveals the importance of the discussion on the need to ensure the effective social protection of refugees. In Brazil, in view of the notion evolution of social protection and the increase in state intervention, Article 203 - item V, of the Magna Carta, instituted the benefit of continued provision in the social assistance subsystem, guaranteeing disabled people and the elderly in need, a monthly payment in the amount of a minimum wage and, therefore, ensuring the minimum necessary for the dignified existence of the individuals. In this sense, using the precepts engendered by the Federal Constitution of 1988, by international treaties and instruments, by ordinary legislation and the understanding consolidated by the Supreme Federal Court, and approach is taken on the possibility of guaranteeing the access of refugees residing in Brazil to the continued benefit provision, due to the limitation imposed by some infra-constitutional rules. Therefore, the main objective of the present study is directly linked to the analysis of the need and the possibility of realising the social protection of refugees residing in Brazil, through the granting of the benefit of continuous provision, with the scope of promoting the necessary reflections and providing the possible mechanisms to minimise the impacts caused by this humanitarian crisis
