Resumo: The present study develops a critical reflection about the relation between violations of women's human and fundamental rights and capitalism, culminating in the peak of their mercantilization in human trafficking. From an analysis of the historical and social construction of the concept of gender and the capitalist productive process, we seek, through an intersectional perspective, to point out the oppressions and inequalities that contribute as an instrument of the perpetuation of the capitalist system, as well as those that are perpetuated by such system. Thus, the mercantilization of woman’s life and bodies was analyzed from three different angles, them being publicity and media, prostitution and human trafficking. Through the study of the historical development of human trafficking and relevant international legislation, as well as the evolution of the Brazilian legal system on the subject, we sought out to identify the causes and ways of combating human trafficking. Therefore, from the analysis of the available data on the subjet, although scarce, we tried to trace the profile of the victims of such crime. Finally, an analysis is made of the still recent Bill nº 13.344 of 2016, which considerably alters the existing national legislation on the subject, as well as facing its controversial points and outlining possible perspectives and challenges in the fight against trafficking in persons in Brazil
