Resumo: |
The present work aims to revisit the impact of international economic sanctions on human rights effectiveness, since these sanctions impact on the constitutive freedoms of the populations from the target States, as well as to seek for more appropriate feasible solutions to the matter. Understanding the law as an implementation of human dignity mechanism, the present work advocates the implementation of a political and economic legal regime, which is based on Humanist Capitalism as method to strengthen the constitutive freedoms of peoples and therefore promote the effectiveness of human rights. It also stands for the establishment of an ad hoc court by the United Nations Security Council, as well as the adoption of related coercive measures - including the use of redemptive force - and based on game theory and aimed towards the restoration of human dignity, in cases when the adoption of international sanctions is found necessary |
