Resumo: The process of ownership and exchange of goods is a central element of the legal and economic system, especially in capitalist societies. Its historical development, above all in the transition between the liberal individualism distinctive of modern age to the contemporary Welfare State reveals an interesting study subject about the social and economic function of property rights and ownership, representatives of this process. Based on this premise, the goal of this study is to analyze the arrangement of property rights and ownership in the Brazilian legal system, from the 1916th Civil Code to the present, seeking to investigate the role of the ownership functionalization in the Constitutional Order of 1988. The research is justified by the maintenance of typical elements from the individualistic modern property scheme in the contemporary functionalized structure of property right, which indicates the adaptive evolution of certain legal concepts towards the relationship with the economic order. This research sought a theoretical description of property rights and ownership adding to it the possible interpretations and development of the functionalization of such rights. Finally, the last aim of this study was to demonstrate the possibilities of an emancipative hermeneutical construction of ownership protection, whose functionalization represents greater grasp to the concrete protective perspective of human dignity, in the sense of the maximum and central axiom established by the Constitution of 1988
